Description and Use of our Service
Complete Attire LLC (also referred herein to as “Complete Attire,” “we,” or “our”) provides an online social marketplace where Fashion Designers (defined later herein and called “Sellers”) can list and sell their designed fashion outfits, and buyers can browse and purchase their items. This Service is available through our mobile applications and website located at https://www.completeattire.com (individually and collectively referred to as the "Service")
Please review the following rules that govern the use of our Service. Please note that the use of our Service constitutes your agreement to follow and be bound by these terms. If you do not agree to these or any future terms, do not use, access, or continue to use or access our Service. We reserve the right, in our sole discretion, to change or modify these terms at any time without further notice. If we do so, we will post the changes on the footer page and indicate the date these terms were last revised.
READ THESE TERMS CAREFULLY. THEY INCLUDE AN AGREEMENT TO ARBITRATE DISPUTES AND OTHER IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, REMEDIES, AND OBLIGATIONS. YOUR ACCESS TO AND USE OF OUR SERVICE IS CONDITIONED UPON YOUR ACCEPTANCE OF AND COMPLIANCE WITH THESE TERMS. THESE TERMS APPLY TO ALL VISITORS, SHOPPERS, SELLERS, AND DESIGNERS WHO WISH TO ACCESS OR USE OUR SERVICE. THE TERMS INCLUDE, AND INCORPORATE BY REFERENCE, THE FOLLOWING SEPARATE POLICIES: OUR PRIVACY POLICY, FEE POLICY, AND PROHIBITED ITEMS POLICY.
The Service provided is a technology platform that provides an online social marketplace in which Fashion Designers (defined herein and called Sellers) can list and sell their designed fashion outfits, and Buyers can browse and purchase items. All transactions are made directly between the Buyer and the Seller. Complete Attire itself does not sell, ship, or guarantee any items sold by Sellers.Our Service includes the following:
For Sellers:
i)Approval of outfits designed by Sellers;
ii)Listing and marketing assistance for Sellers, if needed;
iii)Paying credit card transaction fees for Sellers;
iv)Providing prepaid, pre-addressed shipping labels and free packaging material for Buyers;
v)Protect Packaging if it gets lost in transit by FedEx;
vi)Customer support for all sales;
vii)Automatically collect the proper sales tax and remit it to the state on the Seller’s behalf.
For Buyers:
i)Approval of outfits designed by Sellers;
ii)Provide prepaid, pre-addressed shipping labels and free packaging material;
iii)Customer assistance.
Disputes between Sellers and Buyers:
Complete Attire will try to facilitate the resolution of disputes between Buyers and Sellers, but we have no control over and do not guarantee the authenticity, fit, or quality of items advertised and sold through our website. Sellers have the exclusive responsibility for their items and to sell and ship items within required shipping windows. Complete Attire will try to resolve issues between Sellers and Buyers;however, it is the Seller's sole responsibility to agree to accept any return based on the condition of the Item.
Changes to Our Service
Complete Attire reserves the right to modify or discontinue, temporarily or permanently, the Service with or without notice. Complete Attire shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.
Accounts
When you create an account with us, whether as a Seller or Buyer, you guarantee that you are above the age of 18 years and that the information you provide is accurate, complete, and current at all times. Inaccurate, Incomplete, or obsolete information may result in the immediate termination of your account. You are responsible for maintaining the confidentiality of your account and password, including but not limited to restricting access to your computer and account. You agree to accept responsibility for any and all activities or actions that occur in your account, whether authorized or not and whether directly or through a third-party Service. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
You may not use a username that is not lawfully available to you, nor a name, symbol, or trademark that is subject to another person’s rights without their authorization. You may not use a username that is considered by us to be offensive, vulgar, or obscene. If you wish to terminate your account, simply discontinue using our Service.
WE RESERVE THE RIGHT TO REFUSE ACCESS TO OUR SERVICE, TERMINATE ACCOUNTS, REMOVE OR EDIT CONTENT, OR CANCEL ORDERS AT OUR SOLE DISCRETION.
Seller Accounts
In order to qualify for creating an account as a Seller with us, you must meet all of the following criteria:
i)18 years of age or older;
ii)Have a valid IRS taxpayer I.D.;
iii)Have a valid physical address;
iv)Be actively engaged in the fashion design business.
Buyer Accounts
In order to qualify for creating an account as a Buyer with us, you must meet all of the following criteria:
i)Be an individual (not a business);
ii)18 years of age or older; and
iii)Provide a valid credit card or PayPal account.
Communications
By creating an account with us, you agree to subscribe to newsletters, marketing or promotional materials and other information we may send. You may opt-out of receiving any, or all, of these communications from us by following the “unsubscribe” link and instructions included in any email we send you.
Content and Intellectual Property
Sellers are solely responsible for their postings, including all descriptions and pictures of items listed or sold via our Service. By posting content on our website, Sellers represent and warrant that:
i) The content is theirs (i.e., they own it) and/or have the right to use it and the right to grant us the rights and license provided in these terms; and
ii)The posting does not violate another person’s privacy rights, publicity rights, copyrights, or any other rights of any kind.
Notwithstanding the foregoing, we reserve the right to terminate any account if we believe it is infringing on another person’s rights.
Subject to the foregoing, Sellers retain any and all of their rights to the content they submit, post, or display on our website and are solely responsible for protecting those rights. Complete Attire assumes no responsibility or liability for any content posted by Sellers or others on our website. However, by posting content on our website, Complete Attire is granted the right and license to use, modify, publish, display, reproduce and distribute such content on and through our Services as we deem necessary and appropriate. Such license includes the right for us to make the content available to other users of the Service, who may also use the content subject to these terms.
Complete Attire has the right, but not the obligation, to monitor, edit, and remove any content posted by users on its website. Any content originally posted by us, as well as our trade name, trademarks, copyrights, and patents, if any, are and remain the exclusive property of Complete Attire LLC. Users may not distribute, modify, transmit, reuse, download, repost, copy, or make other use of such content, names, marks, or patents, in whole or in part, for their own commercial purposes or personal gain without the express advance written permission of Complete Attire.
Item Availability, Errors, and Inaccuracies
Although we endeavor to assure that all information on our website is complete, accurate, and current, we cannot and do not guarantee the accuracy or completeness of item descriptions, prices, shipping information, or any other content, and we have no responsibility for any errors or inaccuracies.
Third-Party Services
Our Service may contain links to third-party websites or services that are not owned or controlled by Complete Attire. You may register for the Service using third party Services (e.g. Facebook, Pinterest, YouTube, Instagram, etc.). By directly integrating these services into the marketplace, we make your Seller page richer and more personalized. To take advantage of these features, we may ask you to register for or log into such Services on the respective websites. Be aware that the use, storage, and disclosure of your information by those third parties is governed solely by their own policies
Complete Attire LLC has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party web sites or Services. We do not warrant the offerings of any of these entities/individuals or their websites. You acknowledge and agree that Complete Attire LLC shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such third-party web sites or Services. We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.
Contests, Sweepstakes, and Promotions
Any contests, sweepstakes or other promotions (collectively "Promotions") made available through our Service may be governed by rules separate from these terms and conditions. If you participate in any promotion, please review the applicable rules. If the rules for a Promotion conflict with these terms and conditions, the promotion rules will govern.
Complete Attire may, from time to time, offer credits to existing and new users. The amount and requirements to earn such credits will be determined, and may change, from time to time in Complete Attire's sole discretion, and such program may be terminated by Complete Attire at any time, in each case with or without notice to you. Sellers should know the existing Complete Attire promotions and agree with the existing promotions that can be applied in your transaction, except for the GET 15% OFF 1 ITEM for first-time registrants. Sellers can inform first-time registrants; Complete Attire will reduce the 15% commission in the Sellers Commission. If the seller is in a different tier and if the selling commission is less than the 15%, the Seller has to take the first registrant remaining discount solely after waiving the Complete Attire commission. Refer to our Seller Fee Policy for the commissions paid by each Tier.
Complete Attire reserves the right to limit the number and/or amount of credits that may be earned with respect to any existing user with or without notice to you. To eligible for a credit, the new user must be an individual that has never registered for the Service. You agree that any credit given cannot be traded for cash and is not transferable to others. If your account has been suspended, you will not be able to use such credits.
Purchase and Sale Transactions
Fees
Complete Attire charges Sellers certain fees for various transactions effected through the Service. Refer to our Seller Fee Policy for the commissions paid by the seller in each Tier. The common FAQ is listed and explained on our Designer Account Page. Unless otherwise stated, all fees are quoted in U.S. dollars. Once all the return windows are completed for order, Complete Attire releases the money to the Seller Account after 30 days from the date of the Product sold.
Taxes; Shipping Costs; Buyer Responsibility:
Items purchased and shipped to Buyers in locations in the U.S. may be subject to applicable state or local taxes. Items purchased and shipped to Buyers in locations outside of the U.S. may also be subject to applicable taxes, including value-added taxes. The amount of taxes is based on a number of factors, including but not limited to the type of items purchased, the Buyer's designated delivery address, and/or the location of the Seller.
Buyers are responsible for paying the applicable purchase price for an item, as well as shipping costs, if any, and paying all applicable taxes and other fees associated with the purchase of any item through our Service.
Buyers may use certain Complete Attire promotions or credits, including Complete Attire credits or credit in a Seller’s account, towards the purchase of items. Depending on the type of promotion or credit used, it may reduce the amount of taxes that apply to a Buyer’s order. The application of the promotion or credit will be reflected at the time of checkout and on the purchase receipt.
When a buyer chooses to make an offer, an estimated amount of taxes will be displayed. The amount of taxes may change and be updated when the order is finalized and completed through the Service.
Collection of Taxes and Commissions
Complete Attire will calculate and include all applicable taxes and fees in the final invoice to the Buyer. Where authorized, Complete Attire will also collect those taxes and fees and remit them to the proper authority at no additional cost to either party. In those states where Complete Attire does not collect taxes or fees on behalf of Sellers, Sellers are solely responsible for collecting and paying any taxes and fees to the appropriate authority as required.
Payment Process
Buyers may pay for items using credit cards, PayPal or other specified payment methods selected when they create an account. You authorize Complete Attire to store that payment information and charge your payment method for any item you purchase via our Service. Buyers represent and warrant that they have the legal right to use any credit card(s) or other payment methods in connection with a purchase and that the information they supply to us is true, correct, and complete. We reserve the right to refuse or cancel your order if fraud or the unauthorized or illegal transaction is suspected.
Marketplace Risk
Complete Attire is a marketplace technology platform and is not directly involved in any transaction between Buyers and Sellers, does not obtain title to any items purchased and does not act as a Buyer, Seller, agent or affiliate of a Buyer or Seller), or broker with respect to any transactions. There are risks that you assume when dealing with other users, including those who may be acting under false pretenses. All of these risks are borne by you and not Complete Attire. We encourage you to use the various functionalities of our Service (e.g., item commenting system and direct messaging platform) to help evaluate the user with whom you are dealing.
FOR EVERY TRANSACTION THAT IS COMMENCED THROUGH OUR SERVICE, YOU MUST MAKE YOUR OWN INDEPENDENT DETERMINATION REGARDING THE STATEMENTS, ITEM DESCRIPTIONS OR THE SELLER’S REPRESENTATIONS AND THE BUYER’S ABILITY TO PAY FOR OR DELIVER THE ITEM(S) OFFERED. PLEASE USE CAUTION, COMMON SENSE, AND PRACTICE SAFE TRADING WHEN DEALING WITH OTHER USERS OR OTHERWISE USING OUR SERVICE.
Purchasing & Selling Procedure
Complete Attire prohibits the listing or sale of any item that is illegal to sell under any applicable law, statute, ordinance, or regulation, including, without limitation, items listed in our Prohibited Items Policy. Sellers must have the legal right to sell the items that they make available for sale through our Service. Item descriptions and prices and all terms of sale must be truthful, accurate, and complete.
Buyers are responsible for reading the full item listing before making an offer. When a Buyer makes an offer that is accepted by the Seller, the Buyer must pay the purchase price, applicable taxes, fees, and shipping costs for the item through our Service.When your product sells, a pre-paid, pre-addressed FedEx Ground shipping label can be generated from Order History to put on your package. As long as you use the Complete Attire provided shipping label, the packaging is fully protected if it gets lost in transit by FedEx. Making sure to any orders above $400 will require a signature upon delivery to provide additional protection.
Sellers must ship the item to the Buyer using the label and corresponding shipping method within three days after receipt of the label. If the Seller does not ship the item within that time period, we will give the Seller a set amount of time to ship the item before we cancel the order.
Shipping labels provided by Complete Attire can be used only to ship the applicable item; (ii) Labels may not be transferred or sold to a third party; (iii) Seller is fully responsible for the contents of any parcels shipped using the Label; and (iv) Seller must comply with the terms and conditions and any other policies or rules imposed by the carrier used to ship the items.
Once the Buyer confirms it has received and accepted the item, then Complete Attire will credit Seller’s account with an amount equal to the purchase price received from the Buyer (less any applicable tax), minus Complete Attire’s commission, as set forth in the Seller Fee Policy
Returns & Refunds
Returns
Buyers have fifteen (15) calendar days to return an item from the date they received it, subject to the following conditions:
i) Items must be in their original condition, i.e. unwashed and unworn. Items that have been worn or washed will not be accepted for return.
ii)Final sale items cannot be returned or exchanged.
iii)The item must be in the original packaging.
iv)The receipt or proof of purchase must be included with the returned item.
v)Buyer must request and receive a Return Authorization from the Seller before sending the item back. Sellers can generate a return shipping label for the Buyer.
Refunds
Your purchase is protected every time you purchase on Complete Attire. You can file for a refund if the order is incorrect, Item not as described, and for incorrect or missing items. The following are not covered: Item does not fit, It's not your style, changed mind, transactions made out of Complete Attire.
A Full refund will be provided only if your refund claim is within 15 days of delivery; We will verify your request and send you a label to return the order to the Seller and refund your payment. All returns must be shipped back within seven days of approval to be eligible for a refund. Otherwise, all sales are final. However, a shipping charge will be deducted from your refund unless you are processing an exchange. Complete Attire releases the payment to the Seller once the return window completed. Complete Attire cannot guarantee a refund if the refund requirements are not met.
Once a Seller has received the returned item, they will inspect it and notify you and us whether your return is approved. We will then initiate a refund to your credit card or other original methods of payment. You should allow 1-2 weeks’ time, depending on your bank or card issuer's policies.
Buying Partners Products through Complete Attire
No more complicated searches in online stores,Complete Attire is an online intermediary that partners with some of the world's best-known brands to offer outfits for all tastes and for all occasions in order to be always trendy!.
Sometimes, when you select a particular product that you wish to buy, you will be taken directly to the third party Complete Attire Partner's website and asked to provide further personal details, which are likely to include your billing and delivery address and payment card details. You are being taken here because that Complete Attire Partner is not part of our Integrated Checkout service. The personal information you enter on these Complete Attire Partner websites will be collected, stored, and processed by these websites' terms and conditions and privacy policy. You must read and accept the terms and conditions and privacy and cookie policies of the Complete Attire Partner website before purchasing your items from them. Complete Attire is not responsible for the terms and conditions, privacy policies, and practices on other sites. The Complete Attire Partners are solely responsible for any issues related to products and services offered on their websites, including but not limited to problems arising from the processing of your transactions on the Complete Attire Partner websites.
Please note that Complete Attire has no responsibility for fulfilling your order, regardless of how you purchase your items through Complete Attire. You should contact the Complete Attire Partner from whom you have bought the item directly regarding any queries you have on the delivery, refund, exchange, or return of the items you purchase.
Indemnification
All users agree to defend, indemnify and hold harmless Complete Attire and its licensee and licensors, employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses, including but not limited to attorney's fees, resulting from or arising out of their use and access of our Service.
Disclaimer and Limitation of Liability
Use of our Service is at the user’s sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. In particular, Complete Attire does not warrant that the Service will function uninterrupted, secure, or be available at any particular time or location. We do not warrant that any errors or defects will be corrected, nor that the Service is free of viruses or other harmful components, nor that the results will be satisfactory.
In no event shall Complete Attire, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from access to or use of or inability to access or use our Service.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE LIMITATIONS ABOVE MAY NOT APPLY TO YOU.
Governing Law, etc.
These terms shall be governed and construed in accordance with the laws of the state of California and the United States, as applicable and without regard to any conflict of law rules. Our failure to enforce any right or provision of these terms is not a waiver of those rights. If any provision of these terms is held to be invalid or unenforceable by a court, the remaining provisions of these terms will remain in effect. These Terms constitute the entire agreement between Complete Attire and users of our Service. They supersede and replace any prior agreements regarding the Service and may not be amended except with our approval.
Dispute Resolution
Any dispute between any user of our Service and Complete Attire, which is not resolved voluntarily between us, shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its rules for either consumer disputes or commercial disputes, as the case may be. The decision of the AAA arbitrator shall be final and not subject to appeal. The arbitrator may, in their discretion, award the prevailing party their reasonable attorneys’ fees and costs along with any other appropriate relief. This arbitration procedure is in lieu of any court trial or other procedure. As a user of our Service, you waive your right to have a trial before a jury.
